《反间谍法》作为新中国成立后规范和加强反间谍工作的第一部法律，是在1993年公布实施的原《国家安全法》的基础上修订而来。2014年11月1日，第十二届全国人大常委会第十一次会议审议通过了《中华人民共和国反间谍法》，并于当日公布实施。
间谍行为主要包括下列五类行为
《反间谍法》第一次对间谍行为作出明确的法律界定。根据《反间谍法》规定，间谍行为主要包括下列五类行为：
（一）间谍组织及其代理人实施或者指使、资助他人实施，或者境内外机构、组织、个人与其相勾结实施的危害中华人民共和国国家安全的活动；
（二）参加间谍组织或者接受间谍组织及其代理人的任务的；
（三）间谍组织及其代理人以外的境外机构、组织、个人实施或者指使、资助他人实施，或者境内机构、组织、个人与其相勾结实施的窃取、刺探、收买或者非法提供国家秘密或者情报，或者策动、引诱、收买国家工作人员叛变的活动；
（四）为敌人指示攻击目标的；
（五）进行其他间谍活动的。

国家安全，人人有责
间谍活动不是“远在天边”，而是“近在眼前”。根据国家安全机关统计，退伍军人、留学生、高校教师、军事发烧友以及军工企业、国防科研单位、政府机关工作人员等都是间谍组织渗透策反的重点目标。尤其是一些年轻网友，很可能在网上聊天、交友的过程中，不知不觉中被伪装身份的境外间谍情报机关人员利用。如果公民和组织发现间谍行为，请立即拨打“12339”国家安全机关受理公民和组织举报电话进行举报，查证属实的将予以奖励。
